The short version

spott.food connects hungry people with independent food trucks. The trucks make and sell the food; we handle discovery and pre-ordering. Customers pay a small skip-the-line fee on card orders. Be decent, pick up what you order, and everybody eats.

1. Who's who

spott.food ("the platform," "we") is operated in Birmingham, Alabama. Food trucks ("owners") are independent businesses and the merchant of record for every food sale, including collecting and remitting their own sales tax. We are not the seller, preparer, or deliverer of any food.

2. Ordering and payment

On payment-enabled trucks, you pay the truck's menu prices plus a skip-the-line convenience fee (currently $0.99) at the time of ordering. Payment is processed by Stripe; the food total goes to the truck and the convenience fee to the platform. On other trucks you pay the truck directly at pickup. Menu prices, availability, and hours are set by each truck and can change.

3. Cancellations, declines, and refunds

You can cancel an order while it is still pending. Once a truck accepts your order, it cannot be cancelled through the platform. If a truck declines a paid order, the food total and convenience fee are refunded automatically to your card; refunds typically appear within 5-10 business days. The convenience fee is otherwise non-refundable once an order is accepted.

4. Pickup and no-shows

Orders are for pickup at the truck's posted location. Paid orders not collected within a reasonable time of being marked ready may be disposed of or resold at the truck's discretion without refund. If something goes wrong with your order, talk to the truck first; contact us if it isn't resolved.

5. Truck owner terms

Listing is free. Owners are responsible for the accuracy of their menu, prices, location, hours, and stock counts; for holding all required permits and licenses; for food safety; and for their own taxes. Payment-enabled owners agree to Stripe's Connected Account Agreement. We may remove listings that are inaccurate, unlawful, or harmful to the platform.

6. Referral program

We pay $50 to the first person a truck names as its referrer, after that truck completes five orders from at least three different customers. One payout per truck. Owners cannot refer their own trucks, and completed orders means orders marked completed, not merely placed. We may modify or end the program at any time; qualified, unpaid referrals earned before a change will still be honored. Referral payments are reportable income to the recipient.

7. Accounts and conduct

Keep your account credentials to yourself and give us accurate information. Don't place orders you don't intend to pick up, manipulate stock or referral counts, scrape the platform, or interfere with other users. We can suspend or terminate accounts that break these terms. You can delete your account at any time from your dashboard.

8. Disclaimers and liability

The platform is provided as-is. We don't guarantee any truck's availability, food quality, or accuracy of listings. To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid us in the ninety days before the claim. Nothing here limits liability that cannot be limited under law.

9. Changes and governing law

We may update these terms; material changes will be posted here with a new date, and continued use means acceptance. These terms are governed by the laws of the State of Alabama. Disputes will be handled in the state or federal courts located in Jefferson County, Alabama.
